Are You Ready for Medicare Secondary Payer Mandatory Reporting?

The clock is ticking, liability insurance (including self-insurers), no-fault insurance, and workers’ compensation insurance carriers must start reporting information concerning their Medicare beneficiaries to CMS on July 1, 2009.

Section 111 of the Medicare Medicaid, and SCHIP Extension Act of 2007 (MMSEA) (P.L. 110-173), adds new Medicare Secondary Payer (MSP) reporting requirements for group health plan (GHP) arrangements and for liability insurance, no-fault insurance, and WC. The purpose of Section 11 MSP reporting is to enable CMS to correctly pay for Medicare covered items and services furnished to Medicare beneficiaries by determining primary versus secondary payer responsibility.

Failure to comply with Mandatory Report can result in penalties of $1,000 per day for each individual for which the information should have been submitted to CMS.

Please email Danielle E. Marone, Esq. at if you have questions concerning Mandatory Reporting.
